This Refund and Cancellation Policy (“Policy”) is part of the Terms of Service governing your use of the SightAI platform operated by Hownosh Ventures, LLC, a California limited liability company doing business as Three29 (“Company,” “we,” “us,” or “our”). This Policy describes the terms applicable to subscription cancellations, refunds, chargebacks, and related billing matters.
1. Subscription Overview
SightAI is offered as a monthly subscription service. All payments are processed through Stripe, our third-party payment processor. Subscription fees are billed in advance at the beginning of each monthly billing cycle.
Certain users may be eligible for a seven (7) day free trial of the Service when activating a valid promotional code. If you do not cancel your subscription before the free trial period ends, your subscription will automatically convert to a paid monthly subscription and your payment method will be charged for the first billing cycle.
2. Cancellation Policy
2.1 How to Cancel
You may cancel your subscription at any time through your account settings within the SightAI platform. You may also request cancellation by contacting us at support@getsightai.com. Cancellations initiated via email will be processed within two (2) business days.
2.2 Effect of Cancellation
When you cancel your subscription:
- Your cancellation will take effect at the end of your current billing period.
- You will retain full access to the Service until the end of the billing period for which you have already paid.
- No further charges will be applied to your payment method after the cancellation takes effect.
- Your account data will be retained for a reasonable period following cancellation in accordance with our Privacy Policy, after which it may be permanently deleted.
2.3 Free Trial Cancellation
If you cancel during your free trial period, you will not be charged. Access to the Service will terminate at the end of the free trial period. To avoid being charged, you must cancel before the free trial expires.
3. Refund Policy
3.1 No Refunds
All subscription payments are non-refundable. Once a billing cycle has begun and payment has been processed, we do not provide full or partial refunds for that billing period, regardless of whether you use the Service during the remainder of the period. This applies to all subscription charges, including the first charge following a free trial conversion.
3.2 Exceptions
In limited circumstances, and solely at our discretion, we may consider issuing a refund or credit. These exceptional cases may include:
- Verified technical failures on our end that prevented you from accessing the Service for a material portion of a billing period and that we were unable to resolve in a timely manner.
- Duplicate charges resulting from a billing system error.
To request an exception, you must contact us at support@getsightai.com within fourteen (14) days of the charge in question. We reserve the right to approve or deny any refund request at our sole discretion.
3.3 No Refunds for Partial Months
We do not issue prorated refunds for partial months of service. If you cancel mid-cycle, you will continue to have access to the Service through the end of that billing period but will not receive a refund for the unused portion.
4. Chargebacks and Disputes
4.1 Contact Us First
If you believe a charge is incorrect or unauthorized, we strongly encourage you to contact us at support@getsightai.com before initiating a chargeback with your bank or credit card provider. We are committed to resolving billing disputes quickly and fairly.
4.2 Chargeback Consequences
If you file a chargeback or payment dispute with your bank or credit card company without first contacting us to attempt resolution:
- Your account and access to the Service may be immediately suspended pending investigation.
- We reserve the right to permanently terminate your account if the chargeback is determined to be unwarranted or fraudulent.
- We may pursue recovery of the disputed amount plus any fees or costs incurred as a result of the chargeback through available legal or collection channels.
- A chargeback administration fee may be applied to your account to cover processing costs.
4.3 Fraudulent Chargebacks
Filing a chargeback for a legitimate charge that you authorized constitutes a violation of these Terms and may be considered fraud. We maintain detailed records of account activity, subscription authorizations, and usage data, and we will provide such records to payment processors and financial institutions as needed to contest illegitimate chargebacks.
5. Failed Payments
If a scheduled payment fails due to an expired card, insufficient funds, or other reasons:
- We will attempt to process the payment again according to standard retry procedures.
- We will notify you via email of the failed payment and request that you update your payment information.
- If payment is not successfully collected within seven (7) days of the initial failure, your access to the Service may be suspended.
- If payment is not resolved within thirty (30) days, your account may be terminated.
6. Pricing Changes
We reserve the right to change subscription pricing at any time. We will provide you with at least thirty (30) days' advance notice of any price increase via email to your registered email address. The new pricing will take effect at the beginning of the billing cycle immediately following the notice period. Your continued use of the Service after a price change constitutes acceptance of the new pricing. If you do not agree with the new pricing, you may cancel your subscription before the price change takes effect.
7. Account Credits
From time to time, we may issue account credits at our sole discretion (for example, as a goodwill gesture or promotional offer). Account credits are non-transferable, have no cash value, cannot be redeemed for cash, and expire upon account termination. Credits will be applied to future billing cycles automatically.
